RELEASE OF EDUCATIONAL RECORDS
(Including Students Receiving Free and Reduced Lunch)
WITHOUT CONSENT
 
 
The Indiana Twenty-first Century Scholars Program was established as a state scholarship program for low-income youth in 1990. Targeting the student population eligible for free lunch, these scholarships offer opportunities for students to attend Indiana colleges tuition-free if they commit to completing their high school education with satisfactory academic performance and to avoiding high-risk behaviors. The Scholars Program further supports the students and strengthens their families by linking them to resources and supports in the community. 
 
To identify economically disadvantaged students, it is important for the Twenty-first Century Scholars personnel to be able to obtain the names of students who are enrolled in the school’s Free and Reduced Lunch program.   School officials may release the names of students receiving free and reduced lunch to Twenty-first Century Scholars personnel without consent from the student or parents.
 
According to Section 34 of the Code of Federal Regulations, Part 99.31(a), “An educational agency or institution may disclose personally identifiable information from an educational record of a student without consent required by Reg. 99.30 if the disclosure meets one or more of the following conditions: (1) The disclosure is to other school officials, including teachers, within the agency or institution whom the agency or institution has determined to have legitimate educational interests. . .”
 
Since the Indiana Twenty-first Century Scholars Program is an institution that has a “legitimate educational interest” and “any record maintained at any place in the school about a student is considered part of the student’s educational record,” (Steve Davis, Director of Student Services, DOE), consent for disclosure is not required to release the list of students participating in the free and reduced lunch program to representatives of the Indiana Twenty-first Century Scholars Program.
